Driver Agreement

Last updated November 3, 2026

This Driver Agreement ("Agreement") is between Fast Dealer Trade LLC, a California limited liability company ("Fast Dealer Trade," "we," "us"), and you, the driver ("you"). It covers the runs you accept through fastdealertrade.com and the Fast Dealer Trade driver app. It works together with our Driver Standards, Terms of Service and Privacy Policy. By checking the box when you apply, or tapping I agree in the driver app, you accept this Agreement.

1. Our relationship

You are an independent contractor, not an employee, partner or agent of Fast Dealer Trade. [Attorney: confirm classification under California's ABC test and revise this section if drivers will be employees.]

  • You choose whether and when to be available, and you may accept or ignore any run offer. Ignoring an offer has no penalty.
  • You may drive for other companies, including competitors, and run your own business.
  • We don't set your hours, require a minimum number of runs or supervise how you drive, beyond following the law, this Agreement and the Driver Standards.
  • You're responsible for your own taxes. We send a Form 1099-NEC each year you earn $600 or more.

2. Who can drive

To take runs, you must:

  • be at least 21 years old and hold a valid California driver's license;
  • pass our driving record check, and agree to periodic re-checks;
  • have a smartphone with the driver app and a working phone number;
  • be able to get yourself to the first dealership of each run; and
  • agree to and follow the Driver Standards.

Tell us within 48 hours if your license is suspended, restricted or revoked, or if you receive a moving violation or DUI arrest. You may not take runs until we've reviewed it.

3. How runs work

  • When a dealership books a trade, we send the offer to available drivers. The first driver to accept gets the run.
  • Accepting is a commitment. If something comes up after you accept, tell us right away so we can reassign the run.
  • You drive the dealership's vehicle to the partner dealership, swap vehicles, and drive the partner's vehicle back.
  • Before you take each vehicle, you confirm the last 8 characters of its VIN in the app. If it doesn't match, don't take the car. Call the store contact or us.
  • Photograph all four corners and the odometer of each vehicle at every pickup and drop-off.
  • Drive directly. No passengers, personal stops or detours.

4. Pay

Item Amount
Run up to 15 driving miles each way $70
Each additional mile, one way $1.50
Dealer cancels after you accept $45, and you don't drive it
  • When you're paid: weekly, every Friday, for runs completed Monday through Sunday of the week before.
  • How you're paid: direct deposit or Zelle to the account you give us.
  • Earnings page: the driver app shows every run, what's been paid and what's coming.
  • Questions: raise any question about a payment within 30 days of the payday it relates to.
  • Expenses: you pay your own costs of getting to and from runs, such as gas, transit or rideshare. We reimburse tolls on a run when you send a receipt within 7 days. [Attorney: confirm expense treatment, including Labor Code section 2802 if drivers are employees.]
  • Pay changes: we may change pay rates going forward with at least 7 days' notice. Changes never affect a run you've already accepted.

5. Vehicles, tickets and accidents

  • No personal use: use a vehicle only for the run, and never let anyone else drive it.
  • Tickets: you're responsible for parking tickets, red-light or speed camera tickets, and moving violations you get during a run.
  • Accidents and damage: if there's an accident, damage, a breakdown or a warning light:
    1. Stop safely and make sure everyone is safe. Call 911 if anyone is hurt.
    2. Take photos, and get the other driver's details and a police report number if there is one.
    3. Call or text Fast Dealer Trade right away, before leaving the scene if possible.
  • Statements: don't admit fault or make agreements with anyone about the damage. We and our insurer handle that.

6. Insurance and responsibility for damage

  • Our coverage: we maintain insurance for vehicles in your care during a run, under our policies as they're in effect from time to time. [Attorney/broker: describe coverage once bound, for example garage keepers and hired and non-owned auto.]
  • Your own insurance: you keep your own personal auto insurance for your own vehicle.
  • Occupational accident coverage: [Broker: confirm whether we provide it, or require drivers to carry it.]
  • What you're responsible for: you are not responsible for ordinary accidents covered by our insurance. You are responsible for loss or damage caused by your gross negligence or willful misconduct, by breaking a zero-tolerance rule in the Driver Standards, or by using a vehicle for anything other than the run. [Attorney: confirm limits, including any deductible sharing.]

7. Background and record checks

Our screening partner checks your driving record when you apply and may re-check it periodically. It collects your authorization separately, under its own disclosures, as required by the Fair Credit Reporting Act and California law.

8. Ratings, reviews and ending access

  • Ratings: dealers rate every run. We review your account under the rules in the Driver Standards.
  • Pausing or removing access: we may pause or end your access for a material breach of this Agreement or the Driver Standards, safety concerns, a disqualifying record check, or repeated low ratings. We'll tell you why before any change, except for zero-tolerance violations.
  • Leaving: you may stop driving at any time by telling us.
  • When either of us ends this Agreement: we still pay what you've earned, and sections 5, 6, 9 and 11 keep applying.

9. Confidentiality

What you see on a run belongs to the dealerships. That includes vehicles, prices, paperwork, customers and store operations.

  • Don't share it.
  • Don't post about it.
  • Don't use it for anything but the run.

This continues after you stop driving.

10. Messages

We send run offers and updates by app alert, text message or both, as you choose in the app's Settings. Texts follow the consent you gave when you applied. Reply STOP to opt out of texts at any time; you'll then rely on app alerts.

11. General

  • Governing law: California law governs this Agreement.
  • Disputes: [Attorney: choose a dispute-resolution method, such as small claims, mediation, or arbitration with California-compliant terms.]
  • Changes to this Agreement: we'll ask you to accept any new version in the app before your next run.
  • Severability: if any part of this Agreement can't be enforced, the rest stays in effect.
  • Whole agreement: this Agreement, the Driver Standards and the Terms of Service are our entire agreement about driving with Fast Dealer Trade.
